I've seen some say that we in management won't be able to find another position with another corporation because we've worked for IBC as management and no one would want us. Couldn't be further from the truth. I have companies that have been contacting for me months. Some colleagues as well. You see, we run in different circles. In the corporate world, it is quite evident that the crisis IBC is in cannot be blamed solely on any one manager or even the entire corporate ladder. Other corporations understand how it is difficult at times to maintain a company's profitability when Labor is involved. I've expressed interest to some of my suitors, but told them I would have to ride this out first. I have two or three positions waiting. I could start tomorrow if I so choose. However, I'm going to wait. Draw my final sizeable bonus, severance, and then vacation the entire month of December and will probably return to work sometime in mid-January. Does your level of education and experience afford you that? Didn't think so.

I was trying to figure out why "they" were being so staunch and why it was so important to get their concessions, because frankly, I don't see how taking the cuts they're talking about is still going to be enought to save IBC "as is". The Good Ole Boy network and the Cronie Crowd know the score. I found that little nugget that Biddeford is talking about. Didn't really register at first, but after looking over everything it hit me like a ton of bricks. We're screwed no matter what. So we may as well go down with a fight. I've been saying NO all along, but after reading the legal stuff it made me realize why. We were sold out boys and girls. Our Union leadership never mentioned this potential pitfall when we were going through this. I wonder why. to teamster and proud: only 292 extension contracts were ratified out of 296. this is a fact. don't even bother argue about it. regardless, how long the extension contracts are good for. but in every extension contract, it states that all extension contracts have to be ratified for ibc to assume each of them when they reorganize if not all of them were ratified, then when they reorganize the old contracts will be in effect. this is in their court documents. if you don't believe what i said, just go and read their court documents. the company does not have intention to negotiate. you will see next week

No Biddeford I did not say that all extensions were not ratified. What I stated was that most contracts were five year deals. Because of the fact that there was language in all contracts regarding profit sharing, there was a lot of pressure to secure and ratify extensions across the country. This was accomplished and we have done our part. Enough is enough. If Jung can't right this ship without taking each and every Teamster for a 33% paycut along with a 15% co-pay on health care along with all of his other ridiculous proposals the neither save or make the company any money; then I say SHUT THIS FUCKER DOWN.

to teamster and proud: the extension contracts specifically say that in each extension that in the event that all extension contracts were ratified, then when the company plan its plan of reorganization, they will assume each individual extension contract. what it means is all extension contracts have to be ratified in order for the compnay to assume them when they submit their plan of reorganization or else, the previous contract bargaining agreements will still be in effect. you stated that not all contract extensions were ratified, therefore when the company reorganizes, the old contracts will be in effect. those old contracts will expire next year!!!. i don't make this up. just go and read their court documents. you guys are all screwed. why do you think the company do not backdown any of their proposals?

If the judge close the company down and tells them to sell assets, there won't be any severance since at the point IBC is closed, ALL remaing assets and proceeds fom the sale of those assets get distributed to the creditors after the attorneys get theirs because the attorneys services will still be required until the company is dissolved.

With Simith taking those routes away and allocating them to other plants in other states if it is still showing a profit it's not as big as it used to be. Do the sales tthat are generated from the product made in Emporia still get allocated to Emporia even tho those routes have now been given away to other plants? Does the plant really show a profit when all it can show is transfer costs to other plants for that product??

BCTW workers got 1 week per year @ 30 hours pay for each year up to a max of 900 hours plus any vacation time owed, if you had less then 10 years you lost 3 years qualifing time, over ten then you got it back. Machinist union workers got the same except they lost 3 years qualifing time no matter what. IBT worker only received last pay checks and vacation pay, no severance pay issued as yet because the teamster are refusing to talk. the other problem that worker were not aware of was they knew they were going to receive these large severance checks so employees turned in adjusted W-4 tax forms so that Uncle Sam would not take such a big bite out of those checks, but this did not work with the severance checks due to each one having to be hand typed and not through the normal payroll check printer. Any severance checks that were over $10000.00 were hit pretty hard with tax, any that were under the $10000. amount got off a lot easier. In other words it was useless to turn in adjusted W-4 with more exemption to aviod tax on severance checks. Medical benefits are good through your total weeks severvance. Nonunion workers not sure what they got.

A few words about severance in So. Cal. First of all, there is/was NOTHING to review as far as severance was concerned for Southern Cal. IBT RSR's! No action by the locals was required for this company to issue severance. The severance clause of the CURRENT contract is simple, easily understood and in the absence of any other "negotiated" phantom contract, totally legally binding. The formula and guidelines for issuing severance is plain and clear and was negotiated in good faith by IBC and all effected IBT locals. It doesn't matter if IBC is in Bankruptcy. Bankruptcy does not release an entity from contractual obligations, only from financial liabilities incurred before the date of the bankruptcy. Therefore there is no action that would have been required by union officials regarding severance. It is a simple contractual obligation. IBC cannot run away from this obligation. Just as it cannot run away from its debtor obligations. If IBC wants to take the chance of stiffing loyal, hardworking, dedicated employees out of severance then it must face the music. First it must answer to its legal authorities (aka BK Judge) who, by the way, can read English in black and white. And it will have to answer to some pretty pissed off employees and there is no telling how some of them might respond if IBC fails to provide severance at lay off time.

Please get this out to Dennis Laughlin or Dave West......Robert Williams has spent the last week working for OroWeat while telling IBC that he is out sick. Correct me if I am wrong but does he not forfeit severence pay by doing this? We see you working Bob. Emporia will be sold to Sara Lee. Along with "most" of the locations throughout the Midwest. Their bid is the highest, bar none. They seriously want to expand their operations here in the heartland as well as beat out the leftover competition. With IBC out of the picture Sara Lee will have a stranglehold on the Midwest. I know this because I have a very credible source, who I for obvious reasons cannot out. The competition has already submitted bids for what they're interested in. No one as of yet has come forward and offered to buy everything, just scraps. Sara Lee has expressed the most interest in the Midwest...especially Emporia. It's practically a done deal. They're just waiting to see what happens like everyone else. They are poised to takeover almost immediately. Everything on the coasts are up in the air, no serious contenders and not much interest at this point. The word I've heard is that no one wants to take on the union burdens associated with the coasts because of the labor costs that comes with them.
