And, I ask you to remember that, despite past concessions, mc lost $113 million last year. Without the changes we are asking for, our company will not survive. I was offered a really good paying job (that I didn't apply for) but because I love my job and my customers I have yet to accept it. I feel like I would be leaving the company in there time of need. I have this awful loyalty an I know they can't return the favor. I pray that our next owner will offer the perks IBC has. IBC has had its problems but for the most part it has been a great company to work for. Bakers Union thank you for trying to save our company. I hate not knowing what is going on. I have a family to support and wish I could easily do it with IBC or leave to the next job and not feel guilty for ditching a company that is going out of business. |

Comment: TO ANONYMOUS who is FLABBERGASTED. You have a point, to an extent. The OLD Board of Directors who was in place when we went into BK, also decided to bring Alverez and his group in. In the ordinary course of a bankruptcy, tha would not be a bad idea. However, in IBC's case, it was not a good idea as Alverez had no idea what was required to turn IBC around. Alverez's history in turnaround's is significant, as he has taken numerous companies in bankruptcy and made them profitable again. Unfortunately, his method of doing so (significant cost-cutting via job reductions) was not the way for IBC to go. Additionally, Alverez decided to exit some accounts and that is why route restructuring took place. When you're losing money, I'm not sure why he wanted to do some of the things he did. Over the long run, Alverez's planwasn't working. At that point, the creditors stepped in, and threatened to sue IBC in court over the fact that the company had not held a meetiing of the Board of Directors and election as specified by the Company's operating rules. To settle the suit, Board permitted an election to take place, and almost ALL of the previous board was replaced. That new board's first order of business was to release Alverez and his group. They approched Jung and ASKED him to look at IBC and determine what could be done. Jung identified our product delivery system as the main culprit in why we were continuing to lose money and identified a plan to change it: Path to Market. Jung was then asked by the Board of Directors to come on board and try to turn IBC around. Obviously, he accepted their offer and is attemptiing to implement his plan. Now...many on here seem to think that PTM won' work, but when you ask them to tell you WHY, all you get is the Dirty Sanchez-like diatribes of vulgarity, threats, and innuendo. PTM has in fact been instituted in a number of other companies, most notably Pepsi and Frito Lay. Although there have been some variations made to the original concept, it is STILL alive and well in those companies TODAY. And in some cases, it was implemented in the late 1980's. A few of the complaints on this board are as follows: formulas changed and product tastes like crap; shelf life won't allow PTM to work; everyone is losing their job. Jung has said (and if people would take the TIME to READ and UNDERSTAND they would SEE it) that Path to Market will work, because we will be going to a SHORTER SHELF LIFE product. How do we do that? How about the additives being added to product to give us the EXTENDED SHELF LIFE? Could that possibly address the first two isses? In the case of losing jobs, less than 20% of the employees will ACTUALLY be affected by changes due to PTM. The company currently experiences 17% turnover PER YEAR in those same jobs. That leaves an actual 3% of employees diretly affected. in addition to that, PTM is NOT being implemented in EVERY depot and EVERY location. PTM will only benefit IBC in those areas which are identified as LARGE metropolitan areas. Therefore, MOST RSR's won't be affected. PTM will change pay structures for NEWLY created positions: merchandisers, swing persons, etc. But the CURRENT RSR pay structure will REMAIN unchanged. It is there in plan text in the proposal. To add to that, if you READ and UNDERSTAND< you know that PTM will be introduced GRADUALLY over a THREE YEAR period. It is NOT a sweeping change that will occur overnight. The Teamsters are also upset with language that gives the Company more latitude and less restriction o make decisions that affect the business. They are concerned about their FEELINGS that Jung is intending to take out all Teamsters and replace them with non-union workers. CAN it happen? Yes. WILL it happen? Most likly, no. WHY? Because if Jung REALY REALLY wanted to make IBC a non-union company, there was a much EASIER way to do it. One that would have been IMMEDIATE and would NOT have required him to even talk to the Teamsters. Buy Jung didnot go that route, he attempted to talk to and work wth the Teamsters. The Teamsters have made SOKME proposals to IBC. And, for their own reasons, IBC is not willing to lisen to those at this time. Wanna know WHY? How about this: One proposal made by the TEAMSTERS was to "put solar panels on the roof of each bakery and run the bakeries on solar power." Seriously. That came from the International. Problem with that proposal is, a) cost: what would it cost to put solar panels on every bakery? millions; b)efficiency: solar power is only 25% as efficent as electricity; c) amount of power needed to run each bakery. So you see, there are some pretty legitimate reasons why there are problems with the company's negotiations with the Teamsters. Court today approved terms of employment and the appointment of Craig Jung
to serve as Chief Executive Officer and a member of the Board of Directors
of Interstate Bakeries Corporation (IBC) (OTC: IBCIQ). At the same time,
the Court approved a motion to extend the maturity date of its
post-petition debtor-in-possession (DIP) financing facility to February 9,
2008 from June 2, 2007.

"We are gratified with the Court's decisions today," said Mike
Anderson, chairman of IBC's Board of Directors. "Craig has deep consumer
goods and direct-store-delivery (DSD) experience and a proven track record
leading difficult performance turnarounds. He is the right person to lead
this company forward."
Mr. Jung said, "I am honored by the confidence the Board and our
constituents have placed in me. I believe in this Company and its
potential. We have iconic brands, loyal customers, and a workforce that
wants to succeed. And, I believe we can."
Core Market Strategy
Regarding strategy, Mr. Jung stated, "I subscribe to a proven strategic
principle: don't reinforce failure; press harder where there's success.
Going forward, we will focus on core markets that are profitable, have
positive cash flow and earn their cost of capital."
Four Priorities
Mr. Jung outlined four priorities for IBC: fix the cost structure to
grow margins; accelerate innovation to realize attractive revenue growth;
drive productivity to improve margins; and create a performance culture.
Mr. Jung said that cost structure is IBC's dominating challenge near
term, followed close on the heels by innovation.
"Despite the progress of the past two years, our cost structure has not
been aligned to our revenue or today's reality of higher commodity prices
and intense competition. As a result, the Company is still unprofitable and
in Chapter 11. That has to change."
"Rationalizing production and evolving our path to market are among the
opportunities we have to consider in partnership with our customers,
employees and unions," he continued.
Mr. Jung also pointed to strategic innovation as an opportunity.
"Innovation is the lifeblood of profitable firms. We intend to accelerate
relevant innovation, focusing on health and wellness and differentiating
our brands from the competition."
Mr. Jung, 53, succeeds Tony Alvarez II, who had served as interim Chief
Executive Officer of the Company since September 2004. Noting the progress
the Company has achieved since it filed bankruptcy, Mike Anderson
commented, "On behalf of the Board and the Company, I want to again thank
Tony Alvarez for his efforts during these challenging times."
Extension of DIP Financing
At the hearing today, the Court also approved extension of the maturity
date of IBC's post-petition debtor-in-possession (DIP) financing facility
to February 9, 2008 from June 2, 2007. The Company said that it needed the
extension in order to insure sufficient financial backing and time to allow
Mr. Jung an opportunity to review operations, refine its business plan and
explore exit financing alternatives required to support a plan of
reorganization.
To date, IBC has not borrowed under its $200 million DIP financing
facility, although it has issued letters of credit under the facility in
the amount of $109.1 million, primarily in support of the Company's
insurance programs. J.P. Morgan Chase Bank (JPM Chase), agent for the DIP
financing facility during the bankruptcy cases, will continue to act as
agent for the lending syndicate.

Market distribution centers will pay the same as they currently do. New
categories of warehouse jobs that are created will earn hourly pay that is
competitive in the local market for similar warehouse work.
We intend to use a standard bidding process based on seniority to determine who gets
each job in each market where we implement Path-to-Market. We intend to conduct a
lead market in Memphis, Tennessee, to make sure we have the appropriate equipment
and technology to support Path-to-Market before it is rolled out broadly.
Our business plan calls for half our metropolitan markets to implement Path-to-Market in
September/October 2008, and for the remaining metropolitan markets to implement Pathto-
Market in September/October 2009. Portions of the plan may be implemented sooner.
We do not expect significant layoffs in markets when we implement Path-to-Market.

Profit-Sharing Proposal Affecting All Non-Management Emplovees

This profit-sharing plan would replace less favorable gain-sharing agreements in existing

A Final ReQuest
We now have only a few days left to save our company. We are committed to reaching
agreements with each of our unions that are mutually acceptable and will enable IBC to
secure rational financing to survive and secure our future. At the sametime, while we all
hope for the best, I have an obligation to prepare for the worst. Therefore,in the event
we cannot reach agreement with our other major union the Teamsters by the time we go
to Court October 3 and ratification of that agreement,as well as the recently completed
BCTGM agreement, by October 15, we have asked the Bankruptcy Court to provide us
an additional30 days beyond October5 to develop and begin executing an orderly sale of
all or substantially all of the company and its assets.
Orderly sale processes are typically open to all potential buyers, including competitors,
who are interested in buying all or part of the company and its assets. However, I want to
ensure that every employee understands that no one can guarantee that such a process
will protect your job and benefits.

KANSAS CITY, Mo. (AP) - Interstate Bakeries says it has worked out contract modifications with 1 of the two unions that represent a majority of its 25,000 employees.
The Kansas City-based company makes Hostess Twinkies and Wonder Bread.
The company says the Bakery Workers union is having members vote on the changes, which included health and welfare concessions and changes to the company's distribution network.
Interstate Bakeries has until October 5th to file a plan with court officials for reorganizing itself and ending its 3-year-old bankruptcy case.
If it doesn't meet that deadline, other parties, including its lenders and creditors, can propose reorganization plans of their own.
The company hasn't yet reached an agreement with the Teamsters union, which represents about 10,000 employees.

The purpose of this letter is to share with you the changes the company is proposing and
that we believe are required to ensure IBC\'s survival, success, and fmancial soundness.
The purpose of this letter is to inform you, not negotiate with you.
I am pleased to report that this past Friday, the BCTGM, which represents a substantial
number of our employees, reached agreement with IBC on these required changes,
including a profit-sharing component going forward. We thank BCTGM leadership for
their professional and constructive approach to this situation.
I ask all of our employees, as you read this letter to decide for yourself whether you
believe the changes we are requesting are so radical that they merit risking the loss of our
company and, potentially, your job and benefits. And, I ask you to remember that,
despite past concessions, mc lost $113 million last year. Without the changes we are
asking for, our company will not survive.
Please go directly to the section that best describes your job, read what we\'re asking for,
and gauge the impact it would have on you. The company is not asking for any changes
in its current pension, holiday, or vacation programs whatsoever for any job category.
Union-Represented Hourlv-Paid Emplovees in Plants and Depots
If you are an employeein an mc plant or depot and a memberof a union, throughyour
union, the companyis asking for the followingchanges:

Path-to-Market compensation, as laid out in our business plan and required by potential
investors, would work as follows:
. Field Sales Associates (pre Sell Sales Reps) will work five days a week
and have two consecutive days off, including one weekend day (either
Saturday or Sunday). Field Sales Associates will generally call on four to
six high-velocity stores, and be responsible for both bread and cake
products. Because high-velocity stores have higher weekly store averages,
we will reduce commission rates so that average Field Sales Associates
total earnings (base plus commission) will he close, or equal, to the
average total earnings of an RSR in the metropolitan market for the 52
weeks preceding Path-to-Market implementation. In addition, Field Sales
Associates will have the opportunity to increase their earnings as
improved store-level selling capability, superior store-level customer
service, and fewer out-of-stocks should drive profitable net revenue
growth.
. Alternate Field Sales Associates (Alternate or \"Swing\" Pre-Sell Sales
Reps) will work four days a week and have three consecutive days off

Tensions in Interstate Bakeries Corp.’s bankruptcy reorganization intensified Friday when two entities voiced vastly different opinions on recent requests made by IBC.
JPMorgan Chase leads a group of lenders that were owed $450 million when the company filed for bankruptcy in September 2004. It said IBC should have only until Oct. 31, rather than until Jan. 15, to file its reorganization plan.
That opinion was part of an objection filed by JPMorgan on Friday in response to IBC’s Sept. 13 request to extend the deadline for the eighth time.
Friday’s developments are the latest twist in the drama over the future of one of the nation’s largest bakers, one that pits the company, organized labor and various lenders against each other. The parties will face one another Wednesday at a hearing before the U.S. Bankruptcy Court in Kansas City.
IBC has said a number of parties are interested in providing financing if and when it emerges from bankruptcy. But it contends that those proposals are contingent upon reaching new agreements with the International Brotherhood of Teamsters and the Bakery, Confectionery, Tobacco Workers and Grain Millers International Union by Sunday — Sept. 30.
While Interstate and the BCTGM have continued to hold discussions, talks between Interstate and the Teamsters broke down the week of Sept. 10.
Interstate further said that if it is unable to gain such agreements by Sunday, it will ask the court to grant it a 30-day extension, which could include selling the company in whole or in parts.
JPMorgan’s filing acknowledged that Interstate has been actively seeking post-bankruptcy financing, although unsuccessfully, since June.
JPMorgan said the lender group objects to anything other than a single 30-day extension from Oct. 3 to “finalize any real, viable funding proposals, or, if all else fails, develop a comprehensive plan to sell their business.”
Meanwhile, the unsecured creditors committee said it generally supports Interstate’s request for a Jan. 15 deadline, but only if it lifts restrictions on potential investors talking to third parties, including the committee.
Such a restriction has been loudly denounced by the Teamsters, which allege that One Equity Partners and Yucaipa Companies LLC, an investment firm headed by Los Angeles-based billionaire Ron Burkle, have both expressed interest in Interstate. However, the Teamsters contend, neither has been seriously considered by Interstate because they refuse to sign confidentiality agreements that preclude them from talking to third parties, including the unions.
Calls to One Equity Partners and Yucaipa were not returned.
Interstate officials declined to comment on Friday’s filings, but did say they would file their responses on Monday.
The unsecured creditors committee, which includes a representative from the Teamsters, also filed an objection to Interstate’s motion for permission to withdraw from the bread market in Southern California, which it announced in August. That plan entails closing four bakeries and eliminating 1,300 positions, including more than 800 jobs held by Teamsters.
While Interstate says withdrawing from that market is in the course of “ordinary business,” and therefore doesn’t require the court’s permission, the committee says it’s far from ordinary business.
The committee said that it was blindsided by the announcement, but that it’s moot.
“The egg has already been scrambled,” the committee said, and thus the court, at the very least, should delay Interstate’s Oct. 20 withdrawal from the market for 30 days to give the company and unions time to amend collective bargaining agreements that could help the region become profitable.

Comment: Orlando still has a 6pm meeting but the consessions were voted on and passed by a wide margin in the morning meeting,i would say its a done deal here since most showup for the early meeting.
I'm not going to put everything that was voted on now but try and give the big ticket items .

Coverage will end on last day of month following termination(fired,retire and soforth),use to be 90 days.
New employee will be covered after 2 months of employment.It was 3 months,so thats a plus for new hires.
Reduced out of network benifits to 60%.Was 70% but i could be wrong on that.
This is the new RX plan:
RetailRX-30 day supply Genaric-Flat $8,Preferred Brand-flat $30,Non-preferred Brand- $55.
Mail Order -90 Day supply Genaric flat $20,Preferred Brand-flat $60,Non-preferred flat $110.
We are already paying 18.50 a week for health benis but this is what they are adding:Effective Jan.1,09 Additional $2 per week.Effec.Jan 1 2010 add.$2 per week,Effec. Jan. 1,2011 add. $2 per week. So its a 6 dollar a week increase over the 3 yrs.
Last thing is a 40 cent per hour raise in the last yr since we are extending the contract by 1 yr.
Now this is not everthing,just the things that I thought were the highlights.For what its worth I voted no for my own reasons but I can see where people will accept this instead of the fear of losing their job,good luck to members in both unions. |

Louis you posted that you voted it down, what did you vote down, or are you just runing your mouth also. Ask the teamsters about their C-6 plan, it was a premium plan, some were going to strike to keep it. After the contract was settled, the great teamster C-6 plan was cut by the teamster insurance co. not by the company. Nobody in their right mind wants to pay more for anything, but how much is your job worth, how much is your family worth, $2.00 more dollars a week, $4.00 dollars a week, $20.00 dollars a week. Even at $20.00 a week that would be only $1040.00 per year, you would loose that much just in lost vacation time, not to mention lost wages at a new job. Stand strong vote no before you know the issues, show your intelligence, or lack of. Go home to your wives and children and tell them that Dad stood strong, voted no, just to prove a point. When your wife asks what were they asking for tell her $10.00 more per week or $20.00. Therein lies your problem. You have ZERO understanding of how a bankruptcy works. It isn't a matter of WHO the BK Judge "trusts". Who he "trusts" has no bearing. What matters is whether the persons "talking" have STANDING. UNSECURED creditors are third in line in STANDING in a bankruptcy case. If those in line in FRONT of the unsecured creditors are in favor of what IBC is asking for, they, too, may also file a motion with the court. And if they do, having MORE standing than the unsecured creditors, THEIR information will have more bearing on what the Judge decides than the Teamsters.
You see, what you fail to grasp is that the Teamsters, as an organization, are not even a creditor in the bankruptcy proceedings. Here's another little known fact for you: The CREDITORS, when presented with the Company's plan, asked why the Company was NOT ging after the Unions' pension plan, which have a very large (into the billions of dollars) future financial liability to the Company. And JP Morgan was one of those. Funny how JP Morgan speaks out of one side of its mouth seemingly in favor of the Teamsters' position, and spoke previously out of the other side in asking why Union pensions were not addressed as part of the Company's plan. |

The Teamsters have NO standing in any bankruptcy proceeding. They are not OWED anything by IBC. The EMPLOYEES are third in line behind SECURED creditors and EQUITY holders. Therefore, even if IBC were to STOP paying you and liquidate, chances are SLIM that you would even be able to collect on your owed wages. And the Unions have nothing to do with it. Do you NOT think that the BK Judge can see right through what the Teamsters are trying to do? The SECURED and EQUITY Creditors will have FIRST input on what information the BK Judge decides on. Why should the BK Judge grant the Teamsters' request to permit their "investors" access to confidential information that they are not otherwise entitled to under law? |

Comment: you all are so naive. the people who are running the show are the equity committee. remember who demanded the change of directors and new ceo? it was not the unions, it was not the secured or unsecured creditors. it was the equity committee. because of all likely scenerios, the worst one for the equity committee is no concessions, and ibc has to sell all unprofitable bakeries. even with this scenerio, equity holders will get at least $4-5/share after all debt are paid in full. you might ask why equity committee is in control unlike other bankruptcies? well, because it is very likely that all creditors both secured and unsecured will not be impaired. therefore, if they are not impaired, they don't have much say during the bankruptcy process. jp morgan can bitch all they want about extension of deadline, but in the end the judge will have to rule in favor of equity committee just like when they requested a change of board directors. since they know what they will get for the worst case scenerio, and they also know that is what the union fear of the most ie losing half of unionized employees due to closing unprofitable bakeries, it is no surprise that they are not very compromising about demand for concessions. also, if you read the unions and jp morgan objection of deadline extension, their main reason for objection is that ibc has been in bk for more than 3 years, since then then there are already 8 extensions, but the company is still unprofitable, thus they should allow other parties to present their own plans. but think about it, during more than 2 years of those 3, ibc was under the management of alvarez, a union sympathizer. he did not cut far enough, and never demand big enough concessions from unions. He did even change the unprofitable distribution method. that's why ibc was still losing money. jung started 7 months ago, during that time, he made major organization change and improve operating margin during the past 7 months. if alvarez is still here, the unions will gladly go along with his plan ie unsecured creditors will not be paid in full and equity holders will get nothing, and the unprofitable way of conducting business will continue, and likely ibc will end up in bk again. now only 7 months into the job, with great improvement in operating margin, and with a plan that even in the worst scenerio will give full return to unsecured creditors and some to equityholders, you think the judge will not give him the extension? think again. |

Comment: Interstate Bakeries, which has spent $270 million trying to reorganize in Chapter 11, is "bleeding," JP Morgan said in court papers filed Friday. "There needs to be an 'end date' after which management and the constituents must focus 100 percent on selling these businesses to maximize value."
The bank, which represents lenders owed about $539.6 million, said Oct. 31 "is as late at that date can be."
The committee representing unsecured creditors has asked the bankruptcy court to force Interstate Bakeries to consider strategic investors - companies in the same industry interested in buying or investing in the commercial baker. The committee also wants to be included in Interstate's discussions with potential investors.
The Kansas City-based company faces a self-imposed Sunday deadline to reach new labor contracts with its union workers before it starts looking for a buyer.
Earlier this week, the Teamsters said talks with the company had completely broken down. The union, which represents 10,000 Interstate Bakeries workers, said the company appeared to be on a "fast track to liquidation."
Interstate Bakeries next Wednesday will ask the bankruptcy court for an extension of its exclusive Chapter 11 control. If it reaches new labor contracts by Sunday, the company will see an extension through Jan. 15, 2008, to file its Chapter 11 reorganization plan.
If deals aren't in place by this weekend, Interstate will instead seek a one-month extension of its sole Chapter 11 control to "formulate a rational strategy for maximizing value" that may include a sale of the company as a whole or in pieces.
JP Morgan, however, asked the court to end the company's exclusive control no later than Oct. 31 regardless of the outcome of the labor talks. Exclusive periods prevents creditors, shareholders or other stakeholders from filing competing reorganization proposals while a company works on its own.

Comment: So, if your against the company, I assume you're a hard working Union member. You've paid dues and had the strength of the Teamsters behind you. You've paid their leadership to negotiate on your behalf and you accept their expertise in recommending or denouncing a contract or concession. If they reach an agreement and Teamster leadership recommends accepting the concessions, do you vote accordingly, or do you stick it to everyone and vote "NO"? I'm just curious because it seems that so many people here are so angry that they don't want to listen to reason, they don't want to hear alternative plans, they just want to say "NO". But if YOUR leadership recommends the concessions, how do you say "NO". These are your Teamster leaders - you've stood behind your little window signs and signed petitions with the Teamster letterhead. You've quoted Jimmy Hoffa and told stories of the old Teamster days. Now Union leadership says to vote "YES" do you do it? Or, are you so pissed off at everyone that you say screw IBC,, screw the union, screw the employees, screw everyone? If you vote "NO" when Union leadership recommends "YES" what kind of brother Teamster are you? If we stand together we vote the way Union leadership recommends. You go the other way, and you're no brother, you're no Teamster, and you're no good. I have my opinions, but I'm a Teaster first and I will vote how they recommend. That's what we pay them for, this is what they do.

I'll try once more. First...If we don't strike and you just get laid off you do NOT get your sick pay that is ONLY paid when you retire...read the contract ..second EDD ie ..unemployment insurance. deducts vacation pay from your benifits..it's a wash!! Third you may or may not get a severance..who knows!! OK.. so say we ( stupid ) strike, the company shuts down we go into Liquidation guess what...NO UNEMPLOYMENT!! The state see's that as Quitting!!..You walked out and the company had to shut down. The company did'nt FIRE YOU or LAY you off..you left on your OWN!! For those of you hard working people who don't use unemployment insurance you probably don't know...It's paid by the EMPLOYER!!! That's why when you file the employer has a right to appeal it! By striking we ( the laid off ones ) are playing right into the companys hands!! Think of the savings for the company..all those benifits claims they DON'T have to pay!! We are getting backed into a corner..The company is laying to us the union is laying to us..which one do you chose? IBC and BCTGM Reach Agreement
KANSAS CITY, Mo.--(BUSINESS WIRE)--Sept. 28, 2007--Interstate Bakeries Corp. (IBC) (OTC:IBCIQ) today announced that it has reached agreement on contract modifications with the Bakery, Confectionary, Tobacco Workers and Grain Millers International Union (BCTGM). It is the Company's understanding that ratification votes began as early as today by the BCTGM membership.
Craig Jung, CEO, said, "We appreciate the responsiveness, hard work and professionalism that the BCTGM's leadership has demonstrated throughout this difficult process. Their commitment to our company and its employees is to be applauded.
"Our goal from the outset has been to return IBC to profitability through initiatives that lower costs and sustain competitive advantage. I believe these modifications take us a long way toward that goal.
"IBC still holds out hope that we can reach agreement with the Teamsters, but time is running out. We are committed to working 24 hours a day to reach an agreement that is mutually acceptable to our company and the Teamsters," Mr. Jung said.
IBC has said that if agreements regarding modifications to the collective bargaining agreements with the Company's two principal labor unions, the BCTGM and the International Brotherhood of Teamsters, are not reached by September 30, 2007, then it would seek approval of the Bankruptcy Court to extend the exclusive periods within which to file and solicit acceptances of a plan of reorganization for thirty (30) days from the existing deadlines of October 5, 2007 and January 5, 2008, respectively, in order for the Company to have an opportunity to formulate a rational strategy for maximizing value of the bankruptcy estates, including a sale of the Company and/or its assets in its entirety or in a series of transactions. The Bankruptcy Court motion on the extension of the exclusive periods will be heard October 3. |

Two entities have filed limited objections to efforts by Interstate Bakeries Corp. to extend its exclusive right to file a reorganization plan.
JPMorgan Chase Bank N.A., which was owed millions of dollars when Interstate Bakeries filed for bankruptcy in September 2004, says the baking company should only have until the end of October to either put forth its plan of reorganization, or come up with one to liquidate the company in an orderly manner.
That contrasts with Interstate’s request to extend its exclusivity period until Jan. 15, or if that is denied by the court, until the end of October to come up with alternatives, including selling the company in whole or in parts.
Meanwhile the unsecured creditors’ committee, representing thousands of entities owed millions of dollars by Interstate, also filed. The committee supports IBC’s efforts to extend its exclusivity until Jan. 15 but only if it lifts restrictions of potential investors to sign confidentiality agreements that would prohibit them from talking to third parties, including the committee.
The objections to IBC’s request come two days after one filed by the International Brotherhood of Teamsters, which says the maker of Twinkies and Wonder bread has had ample time to develop an exit strategy from bankruptcy, and argues that the motion should be denied altogether.
The matter will be taken up Wednesday by the U.S. Bankruptcy Court in Kansas City.
In midday over-the-counter trading, IBC shares were down 5 cents, or 10 percent, at 45 cents.
